A shift toward outcome-based contracting is transferring liability and risk down the technology services stack, as service buyers increasingly demand payment terms tied to measurable results rather than effort or attempts. This is evidenced by reports that OpenAI is quietly allowing some large enterprise clients to pay only when AI tasks complete successfully, while broader market data from Gartner and CIO Dive indicate 19% of service buyers seek these agreements, yet only 13% of contracts on the provider side currently support them.

Research reviewed in the episode highlights a fundamental gap between investment in AI technologies and visible business outcomes. The National Bureau of Economic Research found that nearly 90% of 6,000 surveyed executives from the US, UK, Germany, and Australia saw no impact from AI on employment or labor productivity over three years. Similarly, Thomson Reuters data indicates 91% of 1,800 professionals believe their organizations are falling short of expected AI value, signaling persistent challenges in measurement and accountability.

Further evidence shows capacity shortfalls as clients adopt advanced AI: TechIsle data reveals partner capabilities significantly diminish beyond initial stages of AI deployment, and Forrester notes measurement is hindered by fragmented data, unreliable baselines, and client-side dependencies. These create governance gaps and concentrate risk on providers, who must define and guarantee outcomes even when they do not control all relevant variables.

For MSPs and IT service providers, this trend increases exposure to contract risk—particularly when upstream vendors do not share liability. Providers should be proactive in defining which outcomes they can guarantee, document client dependencies within contracts, and pilot outcome-based lines within standard agreements. Employing worst-case historical data and keeping pilots limited in scope can help providers quantify risk before wider adoption makes outcome-based terms a baseline expectation in client negotiations.
